You need to hire an attorney when your suit amount exceeds $5,000.00
or when you are seeking damages that is not out of pocket cost for example,
attorney fees, pain and suffering. Small Claims court does not exceed
$5,000.00. If your claim exceeds $5,000.00 you need to be represented
by an attorney in both Justice and District Court.
NRS.7.285 prohibits court personnel from giving any legal advise.
A counter-claim is when the defendant is counter-suing the plaintiff
for out of pocket cost, on the plaintiffs original suit. In this situation
its best to get the advise of an attorney, to insure that you should
pursue your suit or reach a settlement, before your court hearing.
If you decide to use an Attorney in Small Claims Court you will not
be awarded attorneys fees.
